Hereinafter referred to as the “Seller” or the “Sole Trader”.

PREAMBLE

The Vendor is a publisher of caving Products and Services for consumers, marketed via its website(ardeche-meandre-speleo.com). The list and description of the goods and services offered by the IS can be consulted on the aforementioned site.

These General Terms and Conditions of Sale determine the rights and obligations of the parties in connection with the online sale of Products or Services offered by the Seller.

THE OFFER

Prices are clearly displayed inclusive of VAT (article 293B of the French General Tax Code).

The price per activity includes supervision by a state-certified instructor with professional liability insurance and the technical equipment required for the activity (harness, ropes, descenders, rope ascenders, wetsuits, helmets, lighting, bag, watertight containers, etc).

CONDITIONS OF PARTICIPATION

The activities on offer are open to all, but depending on the activity and route, certain conditions must be taken into account: age limit, technical or physical level. To find out what these conditions are, please refer to the course descriptions and ask your contact person for advice if necessary(ardechemeandre@gmail.com / 06 03 74 52 50).

You must not have any medical contraindications to caving.

Please note If you do not have any medical contraindications, but you are dependent on special medical care or treatment, or your state of health requires special attention, you must inform the office at the time of booking and the instructor before the start of the activity.

INSURANCE

Your instructor is covered by professional indemnity insurance for the activities he/she supervises, in accordance with his/her qualifications and prerogatives(link to qualifications, professional card and liability insurance). However, you are strongly advised to take out individual insurance cover (civil liability and individual accident cover) for damage caused or suffered in the event of incidents or accidents :

– not directly related to the activities.
– not resulting from a fault on the part of the instructor or a defect in the equipment.

CANCELLATIONS

The balance will be returned in full if the professional and the company responsible for supervising you are informed of your cancellation at least 30 days before the date of the booking for groups of more than 6 people, or at least 15 days before the date of the booking for all other cases. 50% of the balance will be reimbursed if the professional and the management company are informed of your cancellation at least 15 days before the deadline for groups of more than 6 people, or at least 7 days before the deadline in all other cases. The balance will not be refunded if cancellations are made less than 15 days in advance for groups of more than 6 people, or 7 days in advance for all other cases.

Refunds will only be made in the event of inability to take part in the activity, on presentation of a medical certificate. This refund will only be made to the person named in the medical certificate; with the exception of minors, who are the responsibility of the accompanying adult.

SPECIAL CANCELLATION CONDITIONS

The company and the instructor in charge of the activity reserve the right to cancel an activity for safety reasons (weather, water levels, flooding, etc.) or for any other case of force majeure.

In such cases, a replacement activity will be organised as far as possible or you will be offered another date. If the outing cannot take place, the service will be refunded in full without any claim for compensation.

ONLY THE INSTRUCTOR IS AUTHORISED TO CANCEL AN ACTIVITY IN THE EVENT OF BAD WEATHER.

Meeting times and delays

An appointment time is systematically communicated whatever the activity. For the smooth running of the activities and out of respect for the other participants, a maximum delay of 15 minutes will be tolerated.

example: for an appointment at 9am, the activity will start at 9.15am.

AFTER THIS TIME, THE INSTRUCTOR(S) WILL LEAVE AND NO REFUND OR COMPENSATION WILL BE DUE.

duration of the activity

The duration of the activity is given as an indication. It may vary depending on the number of participants and their rate of progress.

RESPONSIBILITY

In exceptional circumstances, activity locations may be changed without notice.

Each participant must comply with the rules of caution and safety given by the instructor, who reserves the right to exclude any person whose behaviour compromises the safety or well-being of the group. In this case, no refund will be given.

THEFT

The instructor declines all responsibility in the event of theft or loss of equipment in your vehicles. Do not leave anything in sight on the meeting site and avoid leaving any valuables there.

AUDIOVISUAL PROPERTY AND IMAGE RIGHTS

The instructor reserves the right to use the photos and videos taken during its services to illustrate its brochures, various advertisements, social networks and websites, unless otherwise stated by the participant.

In accordance with the French Data Protection Act no. 78-17 of 6 January 1978, you have the right to access, rectify or delete any information concerning you.

DISPUTES, COMPLAINTS AND CONSUMER MEDIATION

In the event of a dispute between the Customer and the Company, they will endeavour to resolve it amicably (the Customer will send a written complaint to the professional or, where appropriate, to the professional’s Customer Relations Department). In the absence of an amicable agreement or in the absence of a response from the professional within a reasonable period of one (1) month, the Customer who is a consumer within the meaning of article L.133-4 of the French Consumer Code may, if a disagreement persists, refer the matter free of charge to the competent mediator on the list of mediators drawn up by the Commission d’évaluation et de contrôle de la médiation de la consommation (Consumer Mediation Evaluation and Monitoring Commission) pursuant to article L.615-1 of the French Consumer Code, namely :

The customer certifies that he/she has read the general and special terms and conditions of sale and undertakes to inform the participants in his/her group of all the terms and conditions.
